제10차 아시아태평양에이즈대회 성노동자 커뮤니티 선언문 2011·09·14

[편집부] "성노동은 인신매매가 아니다. 성노동(구매와 판매 모두) 범죄화는 우리의 권리를 축소하고, HIV에 취약하게 만든다." 소개글: 이 선언문은 8월 25일 제10차 아이캅대회 성노동자커뮤니티 포럼에서 작성되었다. 각국 성노동자들은 민주적이고 활기찬 논의를 통해 이 선언문을 작성하였으며, 국내에서는 '성노동자권리모임 지지'가 이 과정에 함께 했다. 이 선언문은 8월 26일 부산 벡스코에서 열린 아이캅대회 전 참가자들이 모인 커뮤니티포럼 보고대회에서 한글과 영어로 각각 발표되었다. 세계 10대 회의로 기록되는 아이캅대회는 전세계 HIV감염인들의 인권과 삶의 질 향상을 위한 행사로 2년에 한 번씩 열리며, 이번 대회는 '다양한 목소리, 하나 된 행동(Diverse Voices, United Action)'이라는 주제로 아시아ㆍ태평양에이즈학회(ASAP), 유엔에이즈(UNAIDS)가 공동으로 마련, 8월 30일까지 진행됐다.   제10차 아시아태평양에이즈대회(ICAAP) 성노동자 커뮤니티 선언문 Access to Treatment: Provide affordable, equitable, and non-discriminatory access to treatment and health care services. This includes access to generic ARV and other life-saving medicines and clinical settings where sex workers are treated with dignity and respect. 치료 접근권: 접근 가능하고 공평하고 차별적이지 않은 치료와 건강 관리 서비스가 제공되어야 한다. 이것에는 Generic  ARV와 그 밖에 다른 약들, 그리고 성노동자들이 존중받는 의료 환경을 포함한다. Treatment as Prevention: As sex workers are regularly targeted and our human rights routinely violated in the “control” of HIV, we strongly oppose any mandatory testing and treatment, we expect to benefit from the outcome of clinical research in which we participate, and expect informed consent and bodily autonomy to be respected in the delivery of ethical health programs that target us. Sex workers as leaders must be involved in all decision making and programs that affect us. ARVs must be prioritised for the treatment of people living with HIV before they are used for prevention. 예방으로서의 치료: 성노동자들은 HIV “통제”의 관점으로 인해 폭력을 당한다. 우리는 의무적 검진과 치료를 강하게 거부하고, 우리가 참여한 의료 연구 결과가 우리를 이롭게 하길 원하며, 고지된 동의(informed consent)와 우리를 대상으로 하는 윤리적 건강 프로그램에서 몸의 자율성을 존중받기를 원한다. 리더로서 성노동자는 모든 의사결정과 우리에게 영향을 주는 프로그램에 참여할 수 있어야 한다. ARV는 예방을 위해 사용되기 이전에 감염인(PL)의 치료를 위해 제공되어야 한다. Human Rights: Sex work is work. This must be recognised and respected. Sex work is not trafficking--migrant sex workers should have the right to travel and have their human rights respected. Criminalising sex work (buying or selling) reduces our rights and increases our vulnerability to HIV. Customer oppose the use of condoms as evidence by the police and courts. 인권: 성노동은 노동이다. 이 노동은 가시화되어야하고, 존중받아야 한다. 성노동은 인신매매가 아니다. 이주 성노동자의 인권은 존중되어야 하고, 이동권은 보장되어야 한다. 성노동(구매와 판매 모두)의 범죄화는 우리의 권리를 축소하고, 우리를 HIV에 취약하게 만든다. 또한 고객은 콘돔의 사용을 거부하여 성노동자의 인권을 침해하게 된다. Burning Issue: We must be treated as citizens of our countries with access to justice, anti-discrimination, and industrial rights. We demand the decriminalization of sex work. Laws and policies, civil and religious, that are used to criminalize us must be eliminated. Sex workers demand safe work places. Sex workers demand autonomy and control over how we work, what services we provide, and the right to refuse to provide services. Sex workers living with HIV have the right to work. We reject laws and policies that conflate sex work with human trafficking. Migrant sex workers should have the right to travel and work. Sex workers should not be subject to compulsory testing but provided with holistic health services. Sex workers are an essential part of an effective response to HIV. We must be included, and our communities must be resourced, to mobilise an effective rights-based response and advocate for our  communities. 긴급한  이슈: 우리는 시민으로 대우받아야 한다. 이는 정의에 접근할 권리, 차별받지 않을 권리, 경제적인 권리를 포함한다. 우리는 성노동의 비범죄화를 요구한다. 성노동을 범죄로 바라보는 법과 정책, 시민사회와 종교는 사라져야 한다. 성노동자들은 안전한 일터를 요구한다. 우리는 몸의 자율성과 우리가 제공하는 서비스를 결정하고 어떻게 일할지를 통제할 권리, 서비스 제공을 거절할 권리를 요구한다. HIV와 함께 살아가는 성노동자들도 일할 권리가 있다. 우리는 인신매매와 성노동을 동일시하는 법과 정책을 거부한다. 이주성노동자는 이동하고 노동할 권리가 있다. 성노동자들은 강제검진의 대상이 아니고, 전반적인 의료 서비스를 제공받을 수 있어야 한다. HIV에 효과적으로 대응하는 데에서 성노동자들은 핵심적인 부분을 차지한다. 인권에 기반하여 효과적으로 대응하기 위해 우리는 포함되어야 하고, 우리의 커뮤니티 또한 그를 위한 자원을 제공받아야 한다.                      (번역, 사진 =  성노동자권리모임 지지) [한국인권뉴스]
